People often become involved in the criminal justice system quickly and unexpectedly.  The police use the element of surprise to create an atmosphere favorable to them.  The police are able to accomplish this because the people or suspects with whom they are dealing do not know their rights.  Suspects do not know the difference between what they have to do and what they must do.  By combining surprise, experience, tactics, the target’s lack of information and the target’s belief that he or she can talk themselves out of any trouble that they are in, the police take advantage of people.  The police make their job easier by taking advantage of the inequality between themselves and the suspect.

People with whom the police would like to speak sometimes believe that retaining a lawyer makes them look “more guilty.”  Suspects try to avoid the appearance of guilt by cooperating and not retaining a lawyer to protect them.  As experienced practitioners, Attorneys Crosby & Sughrue believe that if the police want to question you, they already believe you are guilty of something.  Generally, the police only want to speak with a suspect to enhance their case, i.e., make their job easier by obtaining a confession or other statement that makes the likelihood of a guilty plea more probable.  The police are only looking to make their case stronger.  In fact, when police are in trouble themselves, they immediately retain counsel to protect their rights.

When speaking with the police, a person has two choices—tell the truth, the whole truth and nothing but the truth or remain silent.  Attorneys Crosby & Sughrue recommend remaining silent.  Once we are able to get involved, we can protect you from being misquoted by the police or we can educate you enough about the process so that you feel comfortable not cooperating.  By listening to your concerns, we can develop a strategy to deal with the matter at hand.  Early intervention by an attorney sometimes leads to no arrest at all.  Sometimes we are able to solve the problem prior to arrest and make everyone happy.  Sometimes we can stop an investigation or provide information to the police to redirect the investigation to the real culprit.
