      Sexual Offenses 

Rape, statutory rape, sexual assault, statutory sexual assault, indecent assault, aggravated indecent assault are a few of the most serious sexual offenses. Others are involuntary deviate sexual intercourse, indecent exposure and open lewdness. Sexual offenses are usually labeled as a subdivision of crimes of violence. Sexual offenses are usually more complex than normal crimes of violence due to the environment in which sexual offenses usually occur. More often than not ordinary violent crimes happen in public areas or places where there are some other eye witnesses. Sexual offenses, by their very nature, normally occur in secluded, private areas. Most sexual offenses are felonies of varying degrees while others are misdemeanors.

A concern of everyone being investigated for a sexual offense should be Pennsylvania’s version of Megan’s Law. Upon conviction, Megan’s law requires registration with state and/or local law enforcement. Additionally, a person convicted of a sexual offense is often required to have his or her DNA mapped and entered into a database that is accessible by law enforcement world wide.

Defending a sexual allegation is usually a he said—she said type of case due to the seclusion of the location in which most sexual offenses occur. Development of an effective defense usually depends upon how the facts of the case were revealed to investigators. In these types of cases, making no statement to the investigators is imperative. The reason remaining silent is so important is that the investigator at the time of the interview may not know what all of the evidence reveals. If the investigator does not know the strength or weaknesses of the case, how can the accused recognize the approach that would be most successful in responding to questioning? Additionally, with the widespread use of DNA and other forensic evidence by law enforcement, statements by the accused to law enforcement can limit the defenses that might become available after careful analysis of the prosecution’s case.

Sometimes the accused is a perfect stranger and sometimes the accused is an on-again, off-again paramour of the accuser. A past relationship is often a major factor in the development of an effective defense. Past relationships, forensic evidence, witness statements, age of the alleged victim and statements of the accused affect the outcome of all cases involving sexual offenses.
