      Weapons Offenses 

Weapons offenses are status related crimes. Every citizen of Pennsylvania has the ability to carry a weapon, i.e., a firearm. However, except for a limited fact pattern, the citizen must apply for a permit prior to carrying a firearm. Regardless, some people are not allowed to obtain a concealed gun permit, either because of age or prior criminal involvement. Certain mental infirmities also exclude a person from eligibility. All of the nuances of the laws of firearms in Pennsylvania can be found in the Uniform Firearms Act found in Title 18, Chapter 61.

A violation of the uniform firearms act (VUFA as it is commonly referred to), ranges from a felony of varying degrees depending on the facts of the case to a misdemeanor if the accused is otherwise eligible to carry a firearm. These types of offenses do not often arise unless the investigator finds a firearm on a person or in the person’s vehicle. Victory in these cases often lies in technicalities. By technicalities, we mean that perhaps the investigators violated your constitutional rights when finding the firearm. A preliminary hearing, in this instance, goes a long way in gathering information that allows us to properly advise the accused effectively. Additionally although not realistically, the prosecution will not be able meet their burden of proving the fact that disqualifies someone from being able to carry a firearm.

Other less common weapon’s offenses involve certain prohibited offensive weapons such as but not limited to brass knuckles, switch blades, sawed-off shotguns and altered rifles. Regardless of the particular offense, during our free consultation we will strive to educate you as to the probability of success in fighting your case. Often times a lawyer’s involvement is limited to negotiating a solution that will limit the exposure of the accused and keep him or her out of jail. Additionally, our involvement will ensure that the prosecution will be forced to prove their case. If there are potential constitutional infirmities we can negotiate a reduction or withdraw the charges if they are unable to prove their case.

Weapons offenses are often part of a larger criminal episode, meaning that weapons are often used and/or carried by someone who is charged with other offenses. The combination of the other criminal offenses and the presence of weapons often results in mandatory minimum punishments. The presence of weapons with other offenses reduces the importance of a person’s prior contact with the criminal justice system, which might be very little, if any, and expose the accused to a large amount of time in prison.
